IMPORTANT INFORMATION

Caution: To avoid irritation or more serious disease to your eyes, we recommend an annual or semi-annual check-up with your Eye Care Specialist. You must be a previous contact lens wearer before ordering from our website, Desiolens.com. If you have never worn contact lenses before, we recommend that you visit your Eye Care Specialist to establish tolerance to contact lenses first. All of our products are produced in full compliance with The European Economic Community (E.E.C.)

1. GENERAL CONDITIONS

All Terms and Conditions are applied to agreements made on the Desiolens.com website with written acceptance by Desio™. These conditions are formally accepted by the Purchaser at the time of purchase. With confirmation of the order, you declare as the Purchaser that you agree to these conditions. Any changes to the Terms and Conditions shall be considered valid only after written acceptance by Desiolens.com.

2. ORDERS

After ordering, the Purchaser will receive an email with their confirmation and order summary. After acceptance by the Purchaser, the order will be considered binding.

3. SHIPPING

DesioLens.com offers its customers a unique price by NOT charging any shipping costs. You will receive Desio™ color contact lenses at the same price, no matter your country of residence.
If a Purchaser submits a wrong or insufficient delivery address which causes a return of the product to us, the Purchaser agrees to pay 12 Euro to Desiolens.com via Paypal for reshipping and repacking. Desiolens.com agrees to cover the shipping charge only once. In the event that a parcel is returned to our headquarters and the customer requests a refund, the customer is responsible for the initial shipping and handling fees.
Our shipping method utilizes Registered Mail, including the tracking number (RS) for your order. Purchasers agree to track their own orders. Check our Shipping Section for details.

Parcels sent via the the Dutch Post (NL) must initially be tracked via the Dutch Post website. Then once the parcel has been sent abroad, customers must continue to track the parcel via their local postal service.

3.1 Product Availability and Expected Dispatch Times

Please expect 5 days for Plano and Standard prescription and 4 weeks for Special prescription deliveries. In case of Toric lenses (lenses for myopic astigmatism) the delivery time is 6 weeks. We cannot offer any guarantee and the time indicated is approximate. Dispatch days are Monday through Friday and do not include weekends and public holidays. Once your order has been shipped, you will receive a confirmation email which will include your tracking number as proof the consignment was sent. It is necessary to wait a few days before tracking your order as all data must be uploaded by the postal system.
Delivery times are approximate and not exact. Any delay does not constitute the rescission of the contract between Desiolens.com and the Purchaser. If insufficient data is given by the Purchaser to process the order, we will not be responsible for delays in delivery. In case of delays on our part beyond the reasonable time, we will issue a refund to the Purchaser.

3.2 Expected Delivery Time

Delivery times will vary depending on your location. The average delivery time with Registered Mail is:

  • Europe: 8-15 business days
  • United States: 15-20 business days
  • Other Countries: 20-30 business days

Please note that delivery time is approximate. We do not guarantee delivery times.

Desiolens.com takes no responsibility for delays caused by the quality of the postal service in each country.
All products are sent as Registered Mail and the Purchaser must sign personally to receive their own goods. No one else may sign on their behalf.

IMPORTANT NOTE TO ALL CUSTOMERS FROM UK:

Due to problems with the quality of the Royal Mail Service, we do not receive tracking information or updates about shipments. For that reason, your shipment may be held at Heathrow Worldwide DC Centre for weeks.

IF THIS IS NOT ACCEPTABLE TO YOU, PLEASE DO NOT PLACE THE ORDER.

If you still wish to place an order, please accept it will be your decision and acknowledge this situation.

3.3 Import Duties, Sales Taxes or Value Added Taxes

Some countries may charge import and/or sales taxes on contact lenses when the lenses arrive at Customs in the destination country. Desio™ does not have any control over this and it is the Purchaser’s responsibility to pay any applicable taxes as required at the time of delivery in his/her country.

3.4 Responsibilities

Once the item has been sent and the Purchaser has received their tracking number, the Purchaser agrees to take over full responsibility for delivery.

4. PRICING

All prices of the items on our website are in Euro currency with VAT 4% (prescription) or 22% (non-prescription) included and guaranteed at time of order. Shipping charges are covered by Desiolens.com.

5. PAYMENTS

Payments can be made by credit card (Visa, Visa Electron, MasterCard or American Express) or with Post-Pay (Visa). Internet payment transactions are performed in Safe Mode TLS (Transport Layer Service) via UniCredit bank, and are made through PayPal (the worldwide leader in on-line payment transactions). Your personal information will only be held by PayPal, and it will not be visible to us or to any third parties.

6. CLAIMS, RETURNS OR EXCHANGES

The Purchaser has the right to withdraw from any contract within 10 working days (dls 22 May 1999, 185 art. 5) from Postmark. This right does not apply to packages that have been opened, or to the lens construction (toric), except if the goods are damaged or defective. We cannot replace the lens or issue a refund if you do not like the color or the parameters you have ordered are not suitable for your eyes. Customers are required to consult with their Eye Care Specialist BEFORE ordering from our store. We can only accept returns if the lenses are found to be factory defective.

In the case that you receive factory defective lenses, we will exchange them free of charge. Defective contact lenses may only be exchanged for the exact same lens model, color and prescription.

In the case that you receive defective lenses, you must proceed as follows:

  • 1. Contact Desio’s Customer Service Department by logging into your account and submit a ticket within five business days from the receipt of your shipment.
  • 2. Return the defective lenses to Desio, including everything that came in the package with your shipment such as the box, blister and labels.
  • 3. If you have opened the blisters, place the lenses in a lens case with contact lens solution and return them to us with the box and include the opened blisters.
  • 4. Returning defective lenses must be sent within five business days from the time that the customer initially contacted Desio’s Customer Service Department to report the defect.

Insured shipments damaged by the Carrier are not subject to refund. We recommend that you do not accept deliveries which are obviously damaged. For detailed information about returns, please visit our return policy section. The costs of returning the goods to Qualimed will be paid by the Purchaser. The purchaser agrees and accepts this policy.

7. RESPONSIBILITY AND WARRANTIES

All items sold on DesioLens.com are delivered in original packaging and in accordance with the information sent by the Purchaser. We are not responsible for errors in the information made by the Purchaser at the time of order. The responsibility of proper use of the lenses and following the instructions included in each product, falls upon the Purchaser. It is up to the Purchaser to follow proper maintenance, seek eye care and to regulate the tolerability of their own lenses. For this reason, we recommend a visit to your Eye Care Specialist every 6 months and that you follow the advice given in the instructions accompanying our product.

8. PERSONAL INFORMATION

The personal information disclosed by the Purchaser at the time of the order will be retained by DesioLens.com in a computer database. All personal information will be treated solely for the purposes of the correct order entry, business contacts and after-sales service. The customer is free at any time to request the modification or deletion of their own personal information. Any information we receive will not be disclosed to third parties under any circumstances.

9. PLACE OF JURISDICTION

In the case of any disputes arising, the place of jurisdiction will be a court in the province of Milan.

10. COPYRIGHT

Everything you find on DesioLens.com is copyrighted unless otherwise noted and may not be used without the written permission of Desio™. Desio™ neither warrants nor implies that your use of materials displayed on DesioLens.com will not infringe upon the rights of third parties not owned by or affiliated with Desiolens.com. Images and videos of products displayed on the Site are either the property of, or used with permission by, Desio™. The use of these images by you, or anyone else authorized by you, is prohibited. Any unauthorized use of images may violate copyright, trademark, privacy and publicity laws, and/or communication regulations and statutes. Trademarks and logos displayed on the online store, Desiolens.com, are all registered trademarks. Your misuse of the trademarks displayed in our store, or any other content on the store, is strictly prohibited.

11. LIABILITY
