Terms and Conditions

Use of the Qualimed Sites is subject to legally binding Terms and constitutes your agreement to be bound by and to act in accordance with these Terms.
You acknowledge and agree that these Terms, together with our Privacy Policy and our Cookie Policy, constitute the entire agreement between you and Qualimed with respect to access of the sites (included browsing and/or use of any interactive features) of those portions of the Qualimed website.
Qualimed may change these Terms at any time by posting changes on the sites. Any changes are effective immediately upon posting. The continued use of the sites constitutes your agreement to any revised Terms.

   1. GENERAL CONDITIONS

All Terms and Conditions are applied to agreements made on the Desiolens website with written acceptance by Qualimed. These conditions are formally accepted by the Purchaser at the time of purchase. With the confirmation of the order, you declare as the Purchaser that you agree to these conditions. Any changes to the Terms and Conditions shall be considered valid only after written acceptance by Qualimed, in written form, by email.

In consideration of your use of Desiolens.com you agree to provide true, accurate, current and complete information as prompted by Qualimed and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Qualimed has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, it has the right to suspend or terminate your account and refuse any and all current and future use of the Site.

It is strictly forbidden to resale any products purchased through the website or by any other means from Qualimed or its subsidiaries affiliates. By making an order in Desiolens.com, you are declaring that the items are for personal use only and they are not for sale or re-sale.

It is strictly forbidden to sale Qualimed products by the means of online platforms.

   2. CHILDREN PROTECTION

Desiolens.com is not available for users under 18 years. If you are under the age of 18, then your parent or a guardian review and accept this agreement on your behalf through Desiolens.com registration procedure.

   3. ORDERS

After ordering, the Purchaser will receive an email with their confirmation and order summary. After acceptance by the Purchaser, the order will be considered binding.

   4. SHIPPING

If the item is unclaimed or a Purchaser submits a wrong or insufficient delivery address which causes a return of the product to us, the Purchaser agrees to pay the reshipping fee (depending on the selected shipping method) to Qualimed for reshipping and repacking. Qualimed agrees to cover part of the shipping fee only once.

          4.1.Product Availability and Expected Dispatch Times

All lenses available on our online store can take up to 5 business days to be dispatched (except toric lenses that require a production time after pre-order). Dispatch days are Monday through Friday and do not include weekends and public holidays. Once your order has been shipped, you will receive a confirmation email which will include your tracking number as proof the consignment was sent.

          4.2.Expected Delivery Time

Delivery times are approximate and not exact. Any delay does not constitute the rescission of the contract between Qualimed and the Purchaser. If insufficient data is given by the Purchaser to process the order, we will not be responsible for delays in delivery. In case of delays on our part beyond the reasonable time, we will issue a refund to the Purchaser.

Qualimed takes no responsibility for delays caused by the quality of the shipping service in each country.

          4.3.Import Duties, Sales Taxes or Value Added Taxes

Some countries may charge import and/or sales taxes on contact lenses when the lenses arrive at Customs in the destination country. Qualimed does not have any control over this and it is Purchaser’s responsibility to pay any applicable taxes as required at the time of delivery in his/her country.

          4.4.Responsibilities

Once the item has been sent and the Purchaser has received their tracking number, the Purchaser agrees to take over full responsibility for delivery. Purchasers agree to track their own orders. Check our Shipping & Tracking Section for details.

If the tracking for your parcel shows the wording " Delivered", Qualimed is unable to issue any refund.

   5. PRICING

All prices of the items on our website are in Euro currency with VAT 4% (prescription) or 22% (non-prescription) included and guaranteed at the time of order.

   6. PAYMENTS

          a. Credit Card/Stripe

We accept the following cards Visa, MasterCard, American Express and Maestro. Internet payment transactions are performed in Safe Mode TLS (Transport Layer Service).

            b. PayPal

Through PayPal (the worldwide leader in on-line payment transactions), you can link a credit/debit card or directly your bank account. PayPal supports a large number of credit cards, including Visa, MasterCard, American Express, Discover, JCB, Diner's Club and EnRoute. PayPal payments are usually credited within a few minutes. Your personal payment information will only be held by PayPal, and it will not be visible to us or to any third parties.

   7. RIGHT TO WITHDRAW AND RETURN

If you are a consumer (i.e. you are not making a purchase, even in part, for your entrepreneurial initiative, profession, business or artisan activity) you are entitled to withdraw from the contract entered into with Qualimed for the purchase of the Products in accordance with these Terms and Conditions of Sale and in conformity with section 52 et seq. of the Italian Consumer Code (except for personalised Products) and to be refunded by Qualimed any sums already paid. If you intend withdrawing, you shall notify Qualimed in writing thereof through the ticketing system or by registered letter R.R. to Qualimed s.r.l. Viale dell'Unione Europea, 8 Gallarate 21013 – Italy or certified e-mail within 14 (fourteen) working days starting on the date on which the Products were delivered to you or in the case of the purchase of several products with a single order but delivered separately, on the date on which you received the latest product. You will receive e-mail confirmation of withdrawal within the following forty-eight hours later. If you do decide to withdraw, you shall return the Products at your expense and risk, unless Qualimed decides to pay for shipping costs, but in any case it remains the responsibility of the customer to deliver the product to the courier until the return is withdrawn by Qualimed personnel, but in any case it remains the responsibility of the customer to deliver the product to the courier until the return is withdrawn by Qualimed personnel. Make sure the Product is in the same state as you have received it, with its warranty and its original packaging. The online purchase withdraw does not require the exchange of the goods, but only the refund of the amount spent according to the payment method used. If the Products have been paid for with a prepaid card, refunds will be made to the card originally used to make the purchase. All refunds will be made as quickly as possible and in any case within 14 (fourteen) days from receipt by Qualimed of the returned Products.

    8. CLAIMS, RETURNS OR EXCHANGES

Customers are required to consult with their Eye Care Specialist BEFORE ordering from our store. We can only accept returns if the lenses are found to be factory defective.
Any refund will be issued within 120 days from the date of purchase. All refunds will be made in EUR and we will not be liable for any losses incurred as a result of currency fluctuations or exchange rates.
In the case that you receive factory defective lenses, we will exchange them free of charge. Defective contact lenses may only be exchanged for the exact same lens model, color and prescription.

In the case that you receive defective lenses, you must proceed as follows:

            1. Contact Desio’s Customer Service Department by logging into your account and submit a ticket within seven business days from the receipt of your shipment.
            2. Return the defective lenses to Desio, including everything that came in the package with your shipment such as the box, blister and labels.
           
3. If you have opened the blisters, place the lenses in a lens case with contact lens solution and return them to us with the box and include the opened blisters.
           
4. Returning defective lenses must be sent within seven business days from the time that the customer initially contacted Desio’s Customer Service Department to report the defect.

We recommend that you do not accept deliveries which are obviously damaged. For detailed information about returns, please visit our return policy section. The costs of returning the goods to Qualimed will be paid by the Purchaser. The Purchaser agrees and accepts this policy.

   9. RESPONSIBILITY AND WARRANTIES

All items sold on Desiolens.com are delivered in original packaging and in accordance with the information sent by the Purchaser. We are not responsible for errors in the information made by the Purchaser at the time of ordering. The responsibility of proper use of the lenses and following the instructions included in each product, falls upon the Purchaser. It is up to the Purchaser to follow proper maintenance, seek eye care and to regulate the tolerability of their own lenses. For this reason, we recommend a visit to your Eye Care Specialist every 6 months and that you follow the advice given in the instructions accompanying our product.

   10. COUNTERFEIT EDUCATION

As we are a premium brand, counterfeiters try to benefit from our popularity by fooling customers into purchasing fake products. Counterfeit lenses are illegal and may be harmful to your health. A counterfeit product is one that is made of exact imitation of something valuable or important with the intent to deceive the consumer into believing it to be genuine.
Counterfeiting is illegal and damaging to our global economy by removing honest jobs, costing legitimate revenue by not paying taxes, and harming ethical business people. Counterfeiting is not a victimless crime. Consumers who believe they are purchasing genuine items are left with inferior items that cannot live up to their expectations.
Counterfeiters are not accountable to human rights and environmental regulations. Counterfeiters don’t adhere to child labor laws, anti-sweatshop laws, or restricted substances laws, putting both workers and the environment at risk. Fundamental human rights of workers employed by counterfeiters, such as basic safety and health precautions, are often compromised or entirely ignored creating a work environment that is safe for no one. Moreover, counterfeit lenses can be harmful to your health.

Qualimed is very attentive to the safety and quality of the materials used in its products. Lenses are Medical devices highly regulated that require use with caution. Our authentic products are highly regulated and registered by government institutions such as the FDA, CE mark and the ministries of health in all countries we have expanded to. Moreover, Desio™ lenses are in compliance with the ISO International Standards. This ensures that products and services are safe, reliable and of good quality. Counterfeit products do not go through such a vigorous process due to its length and cost.

Qualimed is not responsible for any claims arising from counterfeit products or from purchases of products from unauthorized resellers. Otherwise, if you purchase from an unauthorized channel, be aware that Qualimed shall not be responsible in any way for legal aspects or health issues. Moreover, you can not ask Qualimed to replace items or issue refund referring to lenses purchased from an unauthorized channel.

We combat counterfeiting to safeguard our customer’s eyes and avoid the risk for a number of dangerous health consequences. We vigorously pursue counterfeiters selling counterfeit lenses.

WHERE TO FIND OFFICIAL Desio™ LENSES?
Qualimed does not offer its products through individuals, street vendors, flea markets, internet auctions, boutiques or unauthorized online retailers. Qualimed does not sell its products at wholesale over the internet.
Desio™ lenses are sold through rigorously selected optical stores. To be certain that you are purchasing authentic Desio™ lenses, please visit our store locator to find an authorized retailer near you. If you purchase an item from an authorized Desio™ retailer, you can be assured that the item is authentic.

Report Counterfeits

If you think you have identified or purchased a counterfeit Qualimed product, we would greatly appreciate your help in fighting this battle by reporting the incident to our company. By locating counterfeiters and taking legal action against them, we are doing our part to eliminate future incidents of counterfeiting from occurring.    11. PERSONAL INFORMATION

The personal information disclosed by the Purchaser at the time of the order will be retained by Qualimed is a computer database. All personal information will be treated solely for the purposes of the correct order entry, business contacts, and after-sales service. The customer is free at any time to request the modification or deletion of their own personal information. for further information, please check our Privacy Policy.

   12. RESOLVE A DISPUTE - O.D.R. CLAUSE

Qualimed shall endeavor to resolve any complaint the Purchaser may have. If Qualimed is unable to resolve a dispute, either party is entitled to seek further recourse through the Online Dispute Resolution (ODR) Platform. Operated by the European Commission, the ODR Platform is an online platform providing businesses and customers in the European Union with a forum for resolving Online Sales Disputes without the need to go to court. The dispute resolution services available on the Platform are provided free of charge, although neither party is under any obligation to participate.

   13. PLACE OF JURISDICTION

In the case of any disputes arising, the place of jurisdiction will be Milan, Italy.

   14. COPYRIGHT

Everything you find on DesioLens.com is copyrighted unless otherwise noted and may not be used without the written permission of Qualimed. Qualimed neither warrants nor implies that your use of materials displayed on DesioLens.com will not infringe upon the rights of third parties not owned by or affiliated with Qualimed. Images and videos of products displayed on the Site are either the property of, or used with permission by Qualimed. The use of these images by you, or anyone else authorized by you, is prohibited. Any unauthorized use of images may violate copyright, trademark, privacy and publicity laws, and/or communication regulations and statutes. Trademarks and logos displayed on the online store, Desiolens.com, are all registered trademarks. Your misuse of the trademarks displayed in our store, or any other content on the store, is strictly prohibited.

IMPORTANT INFORMATION

Caution: to avoid irritation or more serious disease to your eyes, we recommend an annual or semi-annual check-up with your Eye Care Specialist. If you have never worn contact lenses before, we recommend that you visit your Eye Care Specialist to establish tolerance to contact lenses first.
